1. Acceptance of Terms

Welcome to TruthCheck ("TruthCheck", "we", "us", or "our"). We provide an AI-powered fact-checking platform and related services accessible at truthcheck.ai (the "Service").

By creating an account, subscribing to any plan, purchasing credits, or otherwise using the Service, you confirm that you: (a) are at least 18 years of age; (b) have read, understood, and agree to be bound by these Terms; (c) agree to our Privacy Policy; and (d) are authorized to enter into this agreement on behalf of yourself or any organization you represent.

⚠️ Important: If you do not agree to these Terms, you may not use the Service. Continued use after any update constitutes acceptance of the revised Terms.

2. Description of Service

TruthCheck provides an AI-powered fact-checking platform that analyzes text, URLs, and images to verify information authenticity and generate credibility reports. The Service is a digital software-as-a-service (SaaS) product delivered over the Internet.

Due to the immediate delivery nature of digital services, refund eligibility is subject to specific limitations as detailed in Section 7.

2.1 AI Model Disclosure

The Service uses third-party AI model providers, including but not limited to OpenAI, Anthropic, and Google. The performance and availability of the Service may be affected by these providers' operational status. Significant disruptions will be communicated to users promptly.

3. User Accounts

To access our services, you must create an account with accurate and complete information. You are responsible for:

  • Maintaining the confidentiality of your login credentials
  • All activities that occur under your account
  • Notifying us immediately of any unauthorized use at security@truthcheck.ai
  • Providing accurate and complete information
  • Ensuring your billing email address remains valid

If you are registering on behalf of a company or organization, you confirm that you are authorized to enter into this agreement on behalf of that entity.

4. Subscription Plans (V1)

We offer subscription plans to access the Service. Current plan details and pricing are available at truthcheck.ai/pricing.

We reserve the right to modify plan features or introduce new plans at any time. Price changes follow Section 5.1.

5. Billing and Payment (V1)

5.1 Automatic Renewal Authorization

When you provide a payment method and subscribe to a paid plan, you hereby authorize TruthCheck to automatically charge your payment method for the corresponding subscription fees on a recurring basis. This recurring authorization remains in effect until you cancel your subscription pursuant to Section 6.

Your subscription auto-renews at the end of each billing cycle unless canceled. For annual subscriptions, we will send a reminder before renewal.

5.2 Taxes

Unless otherwise stated, all prices are exclusive of applicable taxes (including VAT, GST, sales tax, etc.). Where required by law, we will collect and remit such taxes on your behalf.

5.3 Billing Descriptor

Charges will appear on your statement as "TruthCheck" or "TC" followed by the service description. Please ensure you recognize this descriptor to avoid disputes.

6. Cancellation Policy (V1)

6.1 How to Cancel

You may cancel your subscription at any time through:

  • Online (Recommended): Account Settings → Subscription → Cancel Subscription
  • Email: Send a cancellation request from your registered email to cancel@truthcheck.ai

Cancellation takes effect immediately. We will send a confirmation email within 10 minutes.

6.2 Effect of Cancellation

  • Your subscription remains active until the end of the current billing period
  • No further charges will be made in subsequent billing cycles
  • Account data will be retained for 90 days after cancellation, then deleted per our Privacy Policy

7. Refund Policy (V1)

7.1 General Policy

Due to the immediate delivery nature of our digital services, subscription fees are generally non-refundable, except as follows:

7.2 Refundable Cases

  • First-Time Subscriber 7-Day Guarantee: First-time subscribers may request a full refund within 7 days of their first charge, provided usage has not exceeded 20% of the plan quota
  • Duplicate Charges: Full refund for duplicate charges caused by billing errors
  • Verified Service Interruption: Pro-rata refund or credit for verified service interruptions exceeding 72 hours due to our fault
  • Legal Rights: Where applicable laws grant withdrawal or refund rights (e.g., EU/UK 14-day cooling-off period), such rights are preserved

7.3 How to Request a Refund

Send refund requests to refunds@truthcheck.ai with your account email, transaction ID, and reason for the refund. We will confirm receipt within 2 business days and process eligible refunds within 5-10 business days.

7.4 Non-Refundable Cases

  • Charges for subscription periods already used (except as in 7.2)
  • Refund requests for annual subscriptions made more than 30 days after initial purchase
  • Accounts closed due to violation of these Terms or Acceptable Use Policy

8. Billing Disputes

If you believe there is a billing error, please first contact us at billing@truthcheck.ai before contacting your bank. We commit to responding within 2 business days and resolving confirmed billing errors within 5 business days.

9. AI Content and Intellectual Property

9.1 Output Content Ownership

Subject to your compliance with these Terms, AI content generated from your inputs ("Output Content") belongs to you. You may use Output Content for any lawful purpose permitted under Section 10.

9.2 Input Content License

When you submit content to the Service ("Input Content"), you grant TruthCheck a limited, non-exclusive license solely for the purpose of providing the Service to you. We will not use your Input Content for AI model training without your explicit consent.

9.3 Third-Party AI Model Dependency

The Service uses third-party AI model providers, including OpenAI, Anthropic, and Google. Output Content may be influenced by these providers' models. We do not guarantee specific output quality and are not responsible for content generated by third-party models.

9.4 AI Output Accuracy

AI-generated content may contain errors or inaccuracies. You are responsible for reviewing and verifying Output Content before relying on it.

10. Acceptable Use Policy

10.1 Permitted Uses

You may only use the Service for lawful purposes consistent with these Terms.

10.2 Prohibited Uses

You agree NOT to use the Service to:

  • Generate illegal, defamatory, harassing, or fraudulent content
  • Generate, disseminate, or assist in creating deepfake content, including AI-synthesized audio, video, or images impersonating real individuals or intended to mislead viewers about their source or authenticity
  • Generate content involving the sexualization of minors or violating child protection laws
  • Create malware, phishing content, or cyberattack tools
  • Infringe any third party's intellectual property or privacy rights
  • Bypass or interfere with the Service's security features
  • Resell or subpackage access rights without prior written approval
  • Violate any applicable laws, regulations, or card association rules

10.3 AI-Specific Prohibitions

In addition to the general prohibitions above, given the AI nature of the Service, you expressly agree not to:

  • Use the Service's inputs, outputs, model responses, or any derivative data to train, fine-tune, benchmark, distill, or otherwise develop any artificial intelligence or machine learning model that directly or indirectly competes with the Service or TruthCheck products
  • Large-scale systematic scraping, extraction, or collection of model outputs for any purpose beyond your personal authorized use
  • In contexts where it could cause harm, represent AI-generated content as the work of human professionals (such as licensed doctors, lawyers, or financial advisors)

11. Data, Privacy, and Security

Your use of the Service is governed by our Privacy Policy at truthcheck.ai/privacy. Payment card data is processed exclusively by our PCI-DSS compliant payment processor, Waffo Pancake, and is not stored on our servers. Account data is retained for 90 days after cancellation, then deleted.

12. Disclaimer and Limitation of Liability

12.1 Disclaimer

The Service is provided "as is" and "as available" without any express or implied warranties, including merchantability, fitness for a particular purpose, or AI output accuracy.

12.2 AI Content Disclaimer

⚠️ AI Output Disclaimer: The Service's AI outputs may contain inaccuracies, incompleteness, or be outdated. Do not use them for legal, medical, financial, or other professional advice. Always verify with qualified professionals before taking action based on AI content.

12.3 Limitation of Liability

To the maximum extent permitted by applicable law, TruthCheck is not liable for any indirect, incidental, consequential, or punitive damages. Our total liability is limited to the amount you paid us in the 12 months preceding the claim event.

13. Term and Termination

These Terms remain effective during your use of the Service. We may suspend or terminate your account immediately for serious breaches, suspected fraud, or legal requirements. If we terminate for reasons not caused by your breach, we will prorate-refund any prepaid unused portion. You may delete your account at any time by contacting support@truthcheck.ai.

14. Governing Law and Dispute Resolution

These Terms are governed by the laws of the applicable jurisdiction. Before initiating formal proceedings, please contact legal@truthcheck.ai to attempt informal resolution.

15. General Provisions

We may update these Terms at any time. Material changes will be communicated at least 14 days in advance via email. Continued use constitutes acceptance. If any provision is found invalid, the rest remains fully effective. These Terms, together with the Privacy Policy, constitute the complete agreement between you and TruthCheck.
